U.S. Sen. Dianne Feinstein has frozen a bill that she says would gut federal agents' ability to shut down or severely penalize reckless gun dealers.

"This legislation would make it difficult, if not impossible, for the ATF to penalize gun dealers who have broken the law, and to prevent rogue dealers from continuing to sell guns," said Feinstein, D-Calif., in announcing the Senate hold she'd placed on HR 5092. "I cannot consent to allowing such a bill to pass through the Senate without any opportunity to debate the merits or offer amendments."

Feinstein noted that the Federal Law Enforcement Officers Association wrote to Congress on Sept. 25 urging them to oppose the bill, noting it "would have a devastating effect on the ability of law enforcement to stem the flow of firearms from lawbreaking gun dealers to violent criminals."

Any senator can place a "hold" on a bill to keep it from being offered on the floor without 60 senators' approval.

The National Rifle Association, which supports the bill, fired back.

"Dianne Feinstein told '60 Minutes' that if she could get every man and woman to turn their guns in, she would," said NRA spokesman Andrew Arulanandam on Thursday. "As a supporter of draconian gun-control and gun-ban measures, it is not surprising that the senator would stand in the way."

The Bureau of Alcohol, Tobacco, Firearms and Explosives Modernization and Reform Act, introduced by Rep. Howard Coble, R-N.C., and Rep. Bobby Scott, D-Va., differentiates penalties based on the seriousness of the violation and the size of the firearm business, and requires that any ATF decision on a dealer's license be reviewed by an administrative law judge.

Supporters say it gives the ATF more flexibility.

The House passed HR 5092 Tuesday on a 277-131 vote; Arulanandam noted that about a third of House Democrats supported it.

All Bay Area lawmakers except House Resources Committee Chairman Richard Pombo, R-Tracy, voted against it.

"At a time when California cities are seeing a rapid increase in gun homicides, often committed by criminals who get guns through the illegal gun market, now is not the time to be curtailing ATF's power to enforce our gun laws," said Berkeley's Griffin Dix, president of the California Million Mom March Chapters of the Brady Campaign, of the bill recently.]]></description>

No, Sen. Feinstein does not hold a CCW permit.

She doesn't need one.  She has a whole bunch of alternatives to a CCW that are a lot better, and totally out of reach of us mere mortals.

She used to have one, issued by SF (city or county, I don't know).  She gave that up, at a press conference no less.  She did hand in a gun during the press conference.  The rumor is that the gun she handed in actually came out of the evidence room and was to be destroyed anyway; obviously she didn't disarm herself.

There has been a rumor going around the web for a long time that she was made an honorary Federal marshall so she could carry everywhere in the US (including CA and DC), including carrying on to commercial flights without going through the metal detectors.  I recently got confirmation of that rumor from a source I trust, but can't reveal.

But even without that, think about it.

There exists a thing called "congressional immunity".  Congressmen can't be detained except for felonies or treason while congress is in session.  "Detained" is interpretted very broadly, and includes things like searches and maybe even traffic stops.  Carrying without a permit is a misdemeanor, btw, so legally she can't even be hassled for that while congress is in session.

In practice regardless of the legal protection of congressional immunity (which only exists while congress is in session), can you imagine the CHP trying to pull over her limmo?  Can you imagine the CHP asking her to get out of the car?  "Senator, could you please step out of the car.  I'm going to call a female officer to search you for weapons."  If you think such a thing could happen, you don't understand the way the world works.  She could go around with an Uzi in her purse if she wanted to.  Oh and she has secret service agents all the time, too.  Are they going to let some ordinary cop search the senator?  Are they going to arrest her for violating a state law?  No, if some cop wanted to hassle her, they would stand him down.

What cop is dumb enough to not use his discretion when dealing with a powerful senator?  The thought would be, "Um, I'm pretty sure I don't need to search the senator.  I think everything is ok here.  Oh, gee, I just heard someone calling for backup on the other side of town, I better get going...  I'm so happy to have such a nice pension waiting for me when I retire, I better get over to that other call fast!"

All of this is why we need shall-issue CCW.  One great thing about the US is we don't have special classes of people, at least not as far as our legal system is concerned.  This is in contrast to the old European ways, where some people (aristocrats) were not even subject to the civil court system.  It says right there in the Constitution, the US shall not grant titles.  CA's discretionary system is in fact one of the last areas where our system does create special classes of people, and this site aims to fix that problem.

By the way, none of this is knocking against regular cops.  There is just no way they can treat senators like everyone else in routine things like traffic stops.  That's the way of the world, and they certainly should not be faulted for it.
